§1 Provider

§2 Subject matter
Provision of web-based software (software as a service). The subject matter of the contract is exclusively the use of the functions for a limited period, not the transfer of the software itself.
§3 Conclusion of contract
The contract is concluded by clicking „order with obligation to pay“. The user receives a confirmation by email.
§4 Scope of services and terms
BoilingFrog is offered in two tiers:
- Free: free access with no expiry date. Includes the total score, the thermometer and the regime level.
- Premium: monthly subscription (EUR 9.90 per month). Includes all risk layers, trend analysis, drawdown projection and notifications. Can be cancelled monthly with effect from the end of the respective billing period.
An annual upgrade is optionally available (approx. EUR 95 per year, around 20 % discount compared with the monthly subscription).
§5 Prices and payment
The free tier is permanently free of charge. For the premium subscription, the price displayed during the order process applies. Payments are processed by Mollie (Mollie B.V., Amsterdam).
§6 Rights of use
A simple, non-transferable right of use limited in time. No sharing of access credentials, no resale, no automated extraction, no reverse engineering.
§7 Availability
Uninterrupted availability is not guaranteed. Maintenance or technical faults may lead to interruptions.
§8 No investment or asset advisory contract
BoilingFrog provides exclusively algorithmically calculated risk signals based on publicly available market and macroeconomic data. The content does not constitute investment advice, asset advice, financial analysis or a recommendation to buy or sell financial instruments within the meaning of the German Securities Institutions Act (WpIG), MiFID II or comparable regulations.
Users make all investment and financial decisions on their own responsibility. IQRIC Systems OÜ accepts no liability for financial losses resulting from the use of the signals.
§9 Warranty for content
All information is provided without warranty as to accuracy, completeness or timeliness.
§10 Liability
Unlimited only in the case of intent, gross negligence or personal injury. In the case of ordinary negligence, only for breach of material contractual obligations and limited to the typical foreseeable damage. No liability for lost profits, loss of data or indirect damage.
§11 Right of withdrawal
The separate cancellation policy applies.
§12 Data protection
The privacy policy applies.
§13 Final provisions
Estonian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
